Terms of Participation

By entering and participating in the Red Bull X-Alps  (“Event(s)”), you (“Participant”) agree to be bound by these Terms of Participation (“Terms”), by the rulebook which sets out the rules of the event (“Rulebook”) and represent that you satisfy all of the eligibility requirements below. This Event is subject to these terms and to all applicable laws and regulations.

This Event is run by zooom productions GmbH (”Organizer”) whose registered office is located at Felderstraße 12, 5330 Fuschl am See, Austria, and with the support of the cooperation partners such as Red Bull GmbH whose registered office is located at Am Brunnen 1, 5330 Fuschl am See, Austria, and its affiliates (“Red Bull”), agencies and service providers.

01. Eligibility

1.1

In order to participate in this Event, You represent and warrant that You satisfy the following eligibility criteria:

1.1.1

You acknowledge that you are 18 years of age or older at the time of entry.

1.1.2

You represent that you do not have any condition that would prevent you from safely participating in the Event or would pose a present risk to others in your doing so. You also agree that you are not otherwise prohibited from participating in the Event for any reason.

1.2

The Event is open to all applicants who fulfill the eligibility criteria. Please note that the Organizer is not liable in cases where Participants are not legally allowed to take part in the Event due to national or local laws.

1.3

Participants must register as a team (“Team”). A Team consists of two members: one athlete (“Athlete(s)”) and one supporter (“Supporter”).

1.4

Registrations without a Supporter are not allowed.

1.5

Only one entry/registration per Team is allowed.
 

1.6

Only Athletes with a valid official paragliding license (IPPI5) may participate.
 

1.7

All Athletes must be highly qualified and experienced in mountaineering and paragliding to participate in the event.
 

1.8

The following insurances are mandatory:
 

1.8.1

Every Athlete must confirm to have a third party liability insurance for the paraglider used during this competition. The insurance must cover the athlete to the sum of at least €1,5 million.

1.8.2

Every Athlete and (paragliding) Supporter must provide helicopter rescue insurance to cover the possible rescue costs that might arise during the competition. The insurance must also be valid in the countries where the Event takes place with a minimum cover value of €10,000. The helicopter rescue insurance can be part of the accident insurance or the 3rd party liability insurance. These insurances must be provided in either English or German.

1.8.3

All Athletes and Supporters must have their own accident insurance that is valid in all the countries visited during the race. The insurance must cover medical treatment and hospital use for the entire duration of the competition. (NOTE: Many mountain sport policies EXCLUDE competition.)
 

1.9

Each Athlete has to present a sport medical certificate which proves their ability to take part in a long-distance endurance race at check-in. This must include an exercise electrocardiogram with blood pressure, pulse measurement and an electrocardiogram at rest - both as print outs! The certificate must not be older than October 15, 2022. Without the certificate the Team will not be allowed to participate in the competition.

1.10

All Athletes have to carry mandatory equipment as outlined in the Rulebook.
 

1.11

All athletes have to follow the branding rules to be provided shortly after the Athletes Announcement.
 

1.12

You must not hand over the race number to a third person in order to enable the person to participate in the Race in your place.
 

1.13

The Organizer will not accept registrations for the Event that are: (a) automatically generated by computer; (b) completed by third parties (on your behalf) or in bulk; (c) illegible, have been altered, reconstructed, forged or tampered with; or (d) incomplete.
 

1.14

The Organizer reserves the right to verify the email address provided by you including where required identity and/or other provided details at any time at its discretion. In the Event of any dispute, registrations containing an invalid email address or incorrect data regarding the age you will be deemed ineligible.
 

1.15

Please note that the official language of the Event will be English and that all interactions with the Organizer, including these Terms of participation, the registration, and further instructions in the course of the Event, will generally be in English language.

1.16

Prior to being eligible to participate in the Event, you must completely and accurately fill out the online registration on the website.
 

1.17

Each Athlete and Supporter has to sign a disclaimer provided by the Organizer outlining the regulatory requirements and consent to media and branding rules.
 

1.18

Late, illegible, incomplete, defaced, or corrupt registrations will not be accepted. No responsibility can be accepted for lost registrations and proof of transmission will not be accepted as proof of receipt.
 

1.19

The Organizer reserves the right to cancel parts of the Event or the Event in its entirety, to publish such cancellation on the website, and notify registered Participants and/or selected Athletes or Teams via email.
 

1.20

The Participant must have a valid passport with at least 6 months validity and any required visas at the time of the Event.
 

02. Event Period

2.1

The online registration phase for the Event started on July 1, 2022, 12pm (CEST) and ended on August 31, 2022, 6pm (CEST).

The Prologue takes place on June 8, 2023, 10am (CEST).

The Race starts on June 11, 2023, 11:30am (CEST) and ends latest on June 23, 2023, 11:30am (CEST).

Latest arrival for all Teams in the Prologue Location is June 5, 2023, 11am (CEST).

The Organizer reserves the right to change the dates and times and to announce on the Rulebook.

2.2

Applications received by the Organizer outside the registration phase will not be considered and will have no entitlement whatsoever pursuant to these Terms.
 

03. Registration for the Event

3.1

In order to register for the Event, you will be required to take the following steps:
 

3.1.1

Go to the website and click on “Application”.
 

3.1.2

Follow the registration process described on the website and complete the registration form with your personal data, the mandatory questions and the information about your Supporter.
 

3.1.3

On the last step of the registration you will have to agree to these Terms of Participation and accept the Rulebook.
 

3.1.4

Upon completion of this process you will promptly receive a technical email confirming the receipt of your registration and containing your registration data.
 

3.1.5

The confirmation email will also contain hyperlinks to directly access the applicable Terms of Participation and the Rulebook.
 

3.2

The following personal data will be published on the start lists and the results on the website and other media: first name, last name, date of birth, profession, nationality, picture, name of Supporter. The Organizer also reserves the right to publish answered questions as well as named sponsors of the Athlete from the registration form. The time and location of publication of the start lists and the results of the Event will be announced on the website.

3.3

The contact details you provide with your registration will be used to notify you of any updates regarding the Event. Please make sure they are accurate.
 

3.4

In case a participant does not show up in time for on-site check-in at the Event, he/she will have forfeited the right to participate and will have no right to claim a refund. No exceptions in this regard will be considered whatsoever.
 

3.5

Please note that if you decide not to participate in the Event, no refunds will be issued; it is also not possible to transfer the right to participate in the Event to someone else.
 

04. Rules of the Event

For detailed rules and requirements of the Event itself and the on-site check-in at the respective Event Location, please refer to the binding Rulebook and check if there are any updates on the website.
 

05. The Prizes

5.1

The winner(s) of the Race (“Winner”) will be awarded as follows:
1st: €15,000
2nd: €7,500
3rd: €5,000
4th to 15th: €1,500

5.2

Please note that no travel or other costs will be reimbursed for the participation in the Event except for those expressly mentioned in these Terms of Participation.

5.3

The Winners shall remain liable for all taxes (including interest and penalties) due and payable to competent tax authorities in respect of any prize money.

06. Organizer's right to change the terms

6.1

To the extent permitted by law, and without affecting your statutory rights, if in the Organizer’s opinion the Event is compromised by any event beyond the Organizer’s control, the Organizer reserves the right to modify, terminate, amend or extend the Event without responsibility and liability for any amount or kind of loss or damage that may result to you or any third party (whether direct or indirect), which will be visible in our Terms on the website.
 

6.2

At any time during the Event, Organizer reserves the right in its sole discretion to disqualify and remove any participant for any failure to observe these Terms of Participation or the Rulebook or where applicable any other kind of illegal or inappropriate behavior, including but not limited to: his/her behavior at the Event or any Event-related activities at any point is disruptive, may or does cause damage to person, property or the reputation of the Organizer; providing false information on the entry forms; for unsportsmanlike conduct; competing with an unofficial number or race tag; competing with an official number or race tag assigned to another person or from another Event; transferring or attempting to transfer an official number or race tag to, or to obtain such number or tag from, another person; being paced during the race by a person not entered in the Event and for medical or safety reasons. In the event that one of the Winners is disqualified, the award will be forfeited and/or may be donated or awarded to an alternate Winner. No refund will be granted to any disqualified Participant for any reason.

6.3

To the extent permitted by law and except in the case of discretionary cancellation of the Event by the Organizer, hence in case of any cancellation of the Event for a reason outside the Organizer’s sphere of influence, be it force majeure, government orders, or circumstance under which Organizer cannot with reasonable means guarantee Participants’ safety, no refund whatsoever will be granted. An Event may be canceled or changed for any reason, including, without limitation, severe weather or other factors that threaten the safety of Participants, staff, or volunteers.
 

07. Grant of rights

7.1

The Organizer, its sponsors, partners, affiliates and service providers, Red Bull and/or such third parties as they may authorize from time to time will be entitled to capture and use audio recordings, video recordings and photographs from the Event and to use your name, image, voice, appearance, performance and biographical material for any purpose (be it commercial, for merchandising, promotional, editorial, or otherwise) in all media, forever, subject to limitations pursuant to local statutory law. By accepting the present Terms of Participation, you grant the Organizer, its sponsors, partners, affiliates and service providers, and Red Bull the right to use such material.

7.2

The Organizer, its sponsors, partners, affiliates and service providers, and Red Bull will be enabled to use, broadcast, screen, display, reproduce and/or make available to the public the material in any and all media, including but not limited to radio, television, cinemas, events, data carriers and the worldwide web. The Organizer, its sponsors, partners, affiliates and service providers, and Red Bull will – without need of further approval – be entitled to make any alterations, intermissions, cuts or other modifications in and to the material and to use such altered material without restrictions. Furthermore, the Organizer and/or Red Bull is allowed to transfer the granted rights to any third party. You understand that you might not be named as a Participant in the Event and do not expect to gain financially from your appearance in any Event-related material.
 

7.3

The Organizer allows the Participant to use his or her own camera at the Event in order to record moving images and/or a series of still images/ shoot content (“Participant Content”). The use of such Participant Content is limited to private purposes and personal communications. The Participant understands that the Organizer and Red Bull holds the intellectual property and media rights in the event and will, upon request, provide the Organizer and/or Red Bull access to the Participant Content. Any commercial use either by the Participant or third parties is subject to the Organizer’s prior consent.
 

7.4

By accepting the present Terms of Participation, you grant the Organizer and Red Bull the right to use such material under the conditions detailed above.
 

7.5

The sole consideration for this comprehensive assignment and grant of rights shall be to get the chance to participate at and win the race you have registered for at the Event.
 

08. Collection of information and data privacy

Information about how the Red Bull Group may collect, process and store your personal data for the Event and otherwise, can be found within our privacy policy.

09. Liability and warranty

9.1

Insofar as is permitted by law, the Organizer, its sponsors, partners, affiliates and service providers, or Red Bull, its employees, agents or distributors will not in any circumstances be responsible or liable to compensate you accept any liability for any loss, damage, personal injury or death occurring as a result of participation in the Event, as well as taking up the prize(s). Unless such loss arises from the Organizer’s or Red Bull’s failure to respect its contractual and legal obligations, in which case the Organizer, its sponsors, partners, affiliates and service providers, and Red Bull still limits its liability for the abovementioned situations to the extent allowed by applicable law. Your statutory rights are not affected.
 

9.2

The Organizer, its sponsors, partners, affiliates and service providers, and Red Bull shall not be liable for: late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible registrations; telephone, electronic, hardware, or software program, network, internet, or computer malfunctions, failures, delays or difficulties; errors in transmission; prize notification deliveries attempted but not received; any loss suffered by anyone who enters or attempts to enter and/or participate in the Event, whether the entry is lost, not submitted, wrongly processed or does not win.
 

9.3

There is no legal right to participate in this Event. The Organizer, its sponsors, partners, affiliates and service providers are not responsible if you are unable to participate in the Event for any reason.
 

9.4

The Organizer, its sponsors, partners, affiliates and service providers, are not liable if you injure yourself while performing actions with regard to this Event. You represent that you do not have any condition and are not affected by any circumstances that would prevent you from safely participating in the Event or would pose a present risk to others in your doing so. You also agree that you are not otherwise prohibited from participating in the Event for any reason.
 

9.5

In no event shall the Organizer, its sponsors, partners, affiliates and service providers, and Red Bull be responsible or liable for any failure or delay in the performance of its obligations under these Terms of Participation arising out of or caused by, directly or indirectly, circumstances or forces beyond its reasonable control, including but not limited to strikes, work stoppages, accidents, or acts of God, and interruptions, loss or malfunctions of utilities, communications or computer (software or hardware) services, when these circumstances constitute a force majeure as defined under applicable local law.

9.6

To the fullest extent permissible by law, no conditions, warranties or other terms apply to the Event (including, without limitation, any implied warranty of satisfactory quality or fitness for a particular purpose).
 

9.7

You grant to the (medical) staff of the Event and its designees permission to administer or arrange for any medical assistance that they deem necessary or appropriate as a result of your participation, including without limitation, arranging transportation to a hospital or other medical facility.
 

9.8

Organizational measures are announced to you by the Organizer before and during the Event. It is imperative to follow the instructions by the Organizer and its staff members. In case of noncompliance disturbing the proper course of the Event or jeopardizing the security of the other participants, the Organizer is authorized to ban and/or disqualify the person concerned from the Event at any time. Members of the medical services in charge of the competition who are entitled to prohibit a participant from taking part or continuing participating in the Event in case medical symptoms suggest an impossibility to further participate in the race without endangering the participant’s health.
 

9.9

You understand that your participation involves a degree of risk and you willingly assume all risks associated with such participation, including, but not limited to, falls; contact with other Participants, spectators or others, or vehicular or other traffic; the effects of the weather, including heat and/or humidity, wind, dangers associated with running or exercising in the dark, cold temperature, and wet or icy surfaces; falling tree branches or other overhead objects; traffic; and the crowded nature and other conditions of the course, all such risks being known and appreciated by you.
 

9.10

You confirm that neither the Organizer, its sponsors, partners, affiliates and service providers, or Red Bull nor any of its related companies, or cooperation partners is to take responsibility in any way if you get injured. You are in possession of a valid personal liability insurance and personal accident / medical insurance that cover your participation (see mandatory insurances 1.10). If you cause damage arising out of, connected with, or as a result of your participation in the Event, You will be fully responsible and you will make sure that the Organizer, its sponsors, partners, affiliates and service providers, and Red Bull or any of its related companies will not incur any damage in this regard.
 

9.11

Your participation may at any time be refused by the Organizer or its staff if they have reasonable doubt regarding your individual safety in participating in the Event.
 

10. General

10.1

If any provision of the terms shall be held to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions of the terms shall not in any way be affected or impaired thereby.
 

10.2

In the event of any conflict between these Terms of Participation and the Rulebook, the Rulebook shall prevail.

10.3

These terms shall be governed by Austrian Law, and the parties submit to the non-exclusive jurisdiction of the courts competent for the address of the Organizer.
 

10.4

The latest version of the terms will be available on the website.
